Terms and conditions of service

These general conditions govern the Runic GPS tracking service supplied by iMotion S.r.l., sole shareholder company, VAT and tax code 03665821207, together with the online sale of Runic devices.

1. Definitions

“iMotion” means iMotion S.r.l., the supplier of the service. “Runic” means the GPS tracking service developed and marketed by iMotion. “User” means the natural or legal person who has entered into the contract. “Contract” means the order form, these general conditions, the privacy notice and iMotion’s acceptance of the purchase order. “Online purchase” means the purchase procedure completed by the User on runic.io or shop.runic.io. “Tracker” means the satellite tracking device sold by iMotion and installed by the User on the assets to be tracked.

2. Subject matter of the service

The Runic service allows the User to: view on an electronic map the position of assets fitted with a tracker sold by iMotion; review route, driving time and average speed for each asset; receive an immediate alert in case of unexpected stops or movements; and check whether an asset enters or leaves a defined geographic area. Because the service is continuously updated, its full description is published on runic.io.

3. Conclusion of the contract

The contract is concluded at the end of the online purchase procedure: selection of the tracker or service extension; entry of billing and shipping details; choice of payment method; order confirmation with express acceptance of these general conditions; and registration of a personal account in the portal. iMotion may accept or decline any purchase request at its discretion, and acceptance may also occur through conclusive acts such as enabling the service or shipping the trackers.

4. Duration and withdrawal

The contract runs for an indefinite term and takes effect between the parties when iMotion accepts the User’s purchase order. Either party may withdraw at any time by giving notice using the contact channels published on the site. Consumers additionally have the statutory right of withdrawal within 14 days of delivery for goods purchased online.

5. Fees and invoicing

The fees for the service are shown on the Runic site during the online purchase and are expressly accepted by the User on order confirmation. iMotion may adjust fees at any time; adjustments are binding on the User subject to the User’s right of withdrawal. Invoices are issued after payment is received and sent electronically to the email address registered in the portal.

6. Access to the service

The User accesses Runic with the credentials obtained during online registration. iMotion is not required to verify the identity of anyone accessing the service, and the User bears every risk arising from misuse of credentials disclosed directly or indirectly by the User. The User must independently obtain suitable hardware, software and an internet connection compatible with the service; iMotion is not liable for malfunctions caused by the User’s equipment, connection or third-party services.

7. Trackers, SIM cards and returns

Together with the service, the User purchases the tracking devices and any accessories required, which are installed and used entirely at the User’s care and expense. iMotion provides technical documentation and support for correct installation; problems arising from installations that do not follow that documentation are not considered service malfunctions. Each device includes a SIM card provided free of charge on loan for use, which remains the property of iMotion and must be returned or destroyed on withdrawal or termination. Tampering with a device in order to use the SIM for purposes other than the Runic service will be charged to the User.

8. Sale of devices, delivery and warranty

Devices are sold outright and title passes on delivery. Orders are dispatched from our EU warehouse, with the delivery time shown at checkout. Devices carry the statutory legal warranty of conformity — 24 months for consumers — against manufacturing defects; damage caused by incorrect installation, tampering, misuse or accident is excluded. Returns are accepted within 30 days on undamaged devices in their original packaging.

9. Acceptable use

The User may only track assets it owns or is authorised to track, and must inform drivers, employees and users wherever the law requires it. Tracking a person without their knowledge is prohibited. The User is solely responsible for compliance with applicable employment and data protection law.

10. Availability and liability

iMotion aims for continuous availability but depends on mobile networks and satellite positioning; coverage gaps, network outages and scheduled maintenance may interrupt reporting. Runic is a location service and not a security guarantee: iMotion’s liability is limited to the fees paid for the affected device in the preceding twelve months and excludes indirect or consequential loss.

11. Applicable law and jurisdiction

The contract is governed by Italian law. For Users acting as consumers, the competent court is that of the consumer’s place of residence or domicile; in all other cases the court of Bologna, Italy, has exclusive jurisdiction.
